Deeds and Affidavits of Death

WHAT IS

Deeds are legal documents that transfer ownership of real property from one person to another. They are typically used for buying, selling, or gifting property.

Affidavits of Deaths are recorded documents that notify the public that the owner of a property has died. It may be a joint tenant, a trustee, or life-estate holder. When the person dies, the property passes to other joint tenants, trustees, or the person or persons holding a remainder estate.

WHAT THIS PROCESS INVOLVES

  1. Preparing the Deed or Affidavit: The deed must be properly typed with an accurate legal description and a full description of the parties.
  2. Notarization: All signatures must be verified and notarized.
  3. Recording the Deed or Affidavit: The deed or affidavit is filed with the county recorder’s office.
